Victims of police misconduct in Nevada can always file a complaint against the officer. Common grievances are that the police either:
- used excessive force against the victim,
- wrongfully confiscated the victim’s property, and/or
- damaged the victim’s property
Once victims file a complaint, the police department’s review board will conduct an investigation. If the board finds that the complaint is credible, the board may request that the victim come in to give testimony against the officer.
While the investigation is pending, the police department may choose to suspend the police officer with or without paid leave. Depending on the results of the police investigation, the officer may be disciplined or fired. However, the police department will usually not inform the victim about the outcome of the investigation due to privacy concerns.
Victims of police misconduct should always contact a criminal defense attorney prior to making a complaint. An attorney can help determine whether the victim has legitimate grounds for the complaint. Most importantly, the attorney can help the victim word the complaint in such a way so as not to incriminate the victim in any way.
