1. Victorville DUI lawyer Michael Scafiddi

As a former police officer, Victorville DUI lawyer Michael Scafiddi has learned all the tricks of the trade of fighting DUIs. Michael Scafiddi meticulously researches your case to uncover every possible hole in the state's evidence and uses them to help persuade the prosecutors to dismiss or lower your charges. And since he used to be a police officer, he knows exactly how to negotiate with them and how far they are willing to go.

A graduate of California Southern Law School, Victorville drunk driving attorney Michael Scafiddi has defended every kind of DUI case, from California misdemeanor DUI and California DUI causing injury to California felony DUI and California vehicular manslaughter.

2. Your Driver's License

A DUI arrest in Victorville actually triggers two separate cases: One in criminal court (which we talk about below), and one in the Department of Motor Vehicles. Once you are arrested, the officer will confiscate your driver's license and replace it with a temporary thirty-day one. And you have only 10 days from the date of your arrest to contact the DMV and request a hearing to contest the license suspension.

Since California DMV hearings are like mini-trials, you should definitely hire a Victorville DUI attorney right away to request the hearing as well as to appear on your behalf, present evidence, and cross-examine witnesses. If it is your first California misdemeanor DUI, then the DMV may suspend your license for a few months, but we can almost always get you a restricted license so you can continue commuting. License suspensions may last a year or more, however, if you have prior DUIs or if the charge is for California felony DUI.

Note that the DMV and courts may allow DUI defendants to continue driving as long as they install an ignition interlock device (IID) for a predetermined period of time. (California Senate Bill 1046)

3. Your Criminal Case

A Victorville misdemeanor DUI case consists of two charges: DUI under Vehicle Code 23152(a), and Driving with Excessive Blood Alcohol Content under Vehicle Code 23152(b). More serious DUI cases, however, may be chargeable as felonies if someone was injured or killed or if you had three misdemeanor DUI convictions in the past ten years.

Since DUI cases often drag out over several months, we use the time to collect evidence, keep the prosecutors busy with answering motions, and pressure them to resolve your case as positively as possible. And if your charges are for a misdemeanor DUI in Victorville, we will be able to appear for you in court throughout most if not all of your case.

The usual penalties for a first-offense Victorville DUI include the following:

  • a three-to-four figure fine, that we may be able to switch to community service.
  • three years of probation.
  • four-month suspension of your driver's license, but we may be able to get you a "restricted license" so you may continue working or going to school (and you may be able to drive anywhere if you get an ignition interlock device (IID) installed).
  • A few hours of DUI School (read below for more information).
  • two days to six months in jail, that we can usually get suspended or switch to community service.

For subsequent DUIs, the punishments get more rigorous: Higher fines, mandatory jail, longer DUI School programs, and ignition interlock devices in your car.

4. Local Jail & Courthouse Information

People arrested for DUI in Victorville are usually booked at the Victor Valley Jail, a temporary holding facility, located behind the courthouse at 14455 Civic Drive. (Their phone number is (760) 243-8719.)

DUI cases will then be handled in either department four or department eight of the Victorville Courthouse, located at 14455 Civic Drive. Their number is (760) 245-6215. (There is free parking.)

Victorville DUIs are prosecuted only by D.A.'s, and which judge your case is assigned to depends on your case number (even or odd) and whether you have a criminal history. DUI cases rarely have Friday hearings. And if you are sentenced, you can contact the "criminal division" at the Victorville Courthouse at (760) 254-6215 for information about DUI School.
