1. Do I have to give up my license?
When a defendant gets arrested for driving under the influence in Alameda County, he/she not only has a criminal case to deal with — he/she also has to contend with the Department of Motor Vehicles. The moment a defendant is taken into custody, the police officer will swap his/her driver’s license with a thirty-day temporary one.
The defendant then has to contact the DMV within ten days of the arrest to request a hearing – which is like a miniature trial – to argue against the license suspension. When defendants hire a criminal defense attorney right away, the attorney can request the hearing and appear on their behalf to present evidence and cross-examine witnesses – such as the arresting officer.
But even if a first-time DUI defendant loses the DMV hearing and gets a license suspension, the DMV usually lets him/her continue driving as long as they install an ignition interlock device (IID) for the length of the suspension period.
2. What is the standard sentence?
The typical California penalties for pleading to first-time misdemeanor DUI (under Vehicle Code 23152(a) and Vehicle Code 23152(b)) are the following:
- Fines of $1,000 or more
- Three years or more of probation
- A suspended driver’s license for several months (though judges may permit defendants to drive with an ignition interlock device (IID)
- A California DUI School program
- Two days to six months in jail (which is almost always suspendable)
For successive Oakland DUI convictions, penalties become steeper. Fines are higher, jail time may be mandatory, DUI School will last longer, and the judge may order that defendants install an ignition interlock device in their car. And people face felony DUI charges for a fourth-DUI in ten years.

Even for a first drunk driving conviction, an Oakland judge will order defendants to complete California DUI School. This is a several-month-long drug and alcohol education program. How long it lasts depends on how many DUIs they have had and their BAC level at the time of the arrest.
