Penal Code 12022.3 PC is the California statute that creates a firearm sentencing enhancement if you use a firearm or deadly weapon, or are armed with one, during the commission of a certain sex offense. A “certain sex offense” includes (but is not limited to):
The enhancements under this statute can add a term in California State Prison that is in addition and consecutive to the punishment for the underlying sex offense.
According to PC 12022.3:
- if you commit a specified sex offense, and use a firearm or deadly weapon in the commission of that offense, you will be punished by an additional and consecutive prison term of three, four or ten years.
- if you commit a specified sex offense, and are armed with a gun or deadly weapon in the commission of that offense, you will be punished by an additional and consecutive prison term of one, two, or five years.
Examples of when enhanced sentences will be applied under this section include:
- Mark rapes his ex-girlfriend while holding her at gunpoint.
- Jamel commits spousal rape while in possession of a hunting knife.
- Maria performs lewd acts on a minor child, a crime per PC 288, while armed with a handgun.

1. Elements of PC 12022.3
Penal Code 12022.3 PC punishes the use of a firearm or deadly weapon, or being armed with one, during a sex offense. Such offenses include:
- rape, per PC 261,
- rape in concert (PC 264.1),
- sodomy, per PC 286,
- oral copulation, per PC 287,
- lewd acts on a minor child, per PC 288,
- forcible sexual penetration, per PC 289,
- assault with intent to commit specified sexual offenses, as prohibited by PC 220, and
- attempted violations covered by the statute.1
Note that the “commission” of a sexual offense specified in this code section does not end with the completion of the sex act. It continues as long as the assailant maintains control over the victim.
This means a defendant can be found guilty of the enhancement even if they did not show their gun to the alleged victim until after they completed the sex act.2
2. Sentencing Enhancements
If you use a firearm or deadly weapon during a qualifying sex offense, or are armed with one during the offense, then in addition and consecutive to your sentence for the underlying sex offense, you face:

- three, four, or ten years for using a gun or a deadly weapon3, or
- one, two, or five years for being armed with a firearm or a deadly weapon.4
Penal Code 12022.3 distinguishes between personally using a weapon and merely being armed with one.
3. Defenses
Here at Shouse Law Group, we have represented thousands of people charged with weapons offenses, including using or being armed during a sex offense. In our experience, the following six defenses have proven very effective with prosecutors, judges, and juries at getting PC 12022.3 charges reduced or dismissed:
- The underlying offense is not one of the offenses listed in PC 12022.3.
- You were falsely accused.
- The weapon was not used during the commission of the offense.
- You neither used nor were armed with a firearm or deadly weapon.
- The object was not a firearm or deadly weapon.
- The police obtained evidence through misconduct or an unlawful search.
4. Related Offenses
- Furnishing someone with a firearm for use in a felony (PC 12022.4) – Carries an additional one, two, or three years in prison.
- Personally using firearms during the commission of a felony (PC 12022.5) – Carries an additional three to 10 years.
- Personally using a firearm during the commission of a serious felony (PC 12022.53) – Carries an additional prison term of 10 years for using a gun, 20 years for firing a gun, or 25 years to life for killing or seriously injuring another person with a gun.
- This statute is better known as California’s “10-20-life ‘use a gun and you’re done'” law. Some of these “serious felonies” include murder, mayhem, kidnapping, rape, and robbery.
A firearm or deadly weapon used during certain sex offenses can trigger years of additional prison time under Penal Code 12022.3.
Frequently Asked Questions
Can a firearm enhancement apply even if the gun is never fired?
Yes. Under Penal Code 12022.3, prosecutors do not have to prove that a firearm was discharged. The enhancement can apply if the defendant personally used a firearm during the commission of a qualifying sex offense or was armed with a firearm while committing the offense.
What is the difference between being “armed” and “using” a firearm?
A defendant is generally considered armed when a firearm is available for immediate offensive or defensive use. A defendant uses a firearm when the gun plays a role in the crime, such as displaying it, pointing it at the victim, or using it to intimidate the victim.
The enhancement for using a firearm carries a greater additional prison term than merely being armed.
Can a knife trigger Penal Code 12022.3?
Yes. Penal Code 12022.3 applies not only to firearms but also to deadly weapons. Depending on the circumstances, a knife or other object capable of causing death or great bodily injury may qualify as a deadly weapon.
Does Penal Code 12022.3 apply to attempted sex crimes?
It can. The statute expressly applies to certain violations of Penal Code 220 involving an intent to commit specified sexual offenses, such as rape, sodomy, oral copulation, lewd acts with a child, or sexual penetration.
Can the prosecutor seek the enhancement if someone else possessed the weapon?
Usually not. Penal Code 12022.3 requires proof that the defendant either used the firearm or deadly weapon or was armed with it during the commission of the offense. Whether the enhancement applies when another participant possessed the weapon depends on the specific facts and the prosecution’s theory of liability.
Can a judge dismiss a Penal Code 12022.3 enhancement?
In some cases, yes. California judges have authority under Penal Code section 1385 to dismiss sentencing enhancements in the interests of justice. Whether dismissal is appropriate depends on the facts of the case, the defendant’s background, and other relevant circumstances.
Will a Penal Code 12022.3 enhancement affect my immigration status?
Possibly. Many of the underlying sex offenses covered by Penal Code 12022.3 can trigger serious immigration consequences, including deportation or inadmissibility. Non-citizens charged with any qualifying offense should seek advice from both criminal defense and immigration counsel.
Can I expunge a conviction that includes a Penal Code 12022.3 enhancement?
Expungement eligibility depends primarily on the underlying conviction and the defendant’s criminal history. Some defendants convicted of offenses carrying a Penal Code 12022.3 enhancement may later qualify for post-conviction relief, while others may not.
Is Penal Code 12022.3 the same as California’s 10-20-life gun enhancement law?
No. Penal Code 12022.53 is California’s well-known “10-20-life” firearm enhancement statute. Penal Code 12022.3 is a separate enhancement that applies specifically to certain sexual offenses involving firearms or deadly weapons.
How much additional prison time does Penal Code 12022.3 add?
The enhancement can add 3, 4, or 10 years when a defendant personally uses a firearm or deadly weapon during a qualifying offense. If the defendant is armed with a firearm or deadly weapon but does not personally use it, the enhancement can add 1, 2, or 5 years.
