Your Drivers License

A DUI arrest in Victorville actually triggers two separate cases: One in criminal court (which we talk about below), and one in the Department of Motor Vehicles. Once you're arrested, the officer will confiscate your drivers license and replace it with a temporary thirty-day one. And you have only 10 days from the date of your arrest to contact the DMV and request a haring to contest the license suspension.

Your Criminal Case

A Victorville misdemeanor DUI case consists of two charges: DUI under Vehicle Code 23152(a), and Driving with Excessive Blood Alcohol Content under Vehicle Code 23152(b). More serious DUI cases, however, may be chargeable as felonies if someone was injured or killed or if you had three misdemeanor DUI convictions in the past ten years.

Since DUI cases often drag out over several months, we use the time to collect evidence, keep the prosecutors busy with answering motions, and pressure them to resolve your case as positively as possible. And if your charges are for a misdemeanor DUI in Victorville, we'll be able to appear for you in court throughout most if not all of your case.

The usual penalties for a first-offense Victorville DUI include the following:


  • a three-to-four figure fine, that we may be able to switch to community service.


  • 3 years of probation.


  • 4 month suspension of your drivers license, but we may be able to get you a "restricted license" so you may continue working or going to school.


  • A few hours of DUI School (read below for more information).


  • 2 days to 6 months of jail, that we can usually get suspended or switch to community service.

For subsequent DUIs, the punishments get more rigorous: Higher fines, mandatory jail, longer DUI School programs, and ignition interlock devices in your car.
