If you're arrested for DUI in San Jose California, expect to give up your drivers license on the spot (the cop will give you a thirty-day temporary one in exchange). In the meantime, the DMV gives you only ten days from the time of your arrest to contact them and request a hearing, which is like a "mini-trial," to fight your license suspension.
Considering DMVs are notoriously difficult to deal with, we recommend you hire a San Jose DUI defense attorney right away to request the hearing as well as appear in your place. Your license can't be suspended for more than a few months if it's your first DUI, but a second or third DUI may result in two-to-three year suspensions. The typical San Jose DUI arrest results in two charges: 1) DUI under Vehicle Code 23152(a), and 2) Driving with Excessive Blood Alcohol Content under Vehicle Code 23152(b). But if it's your third DUI in ten years, the next one will automatically be charged as a California felony DUI. Several different departments in the courthouse hear DUI cases, and which one you're assigned to depends on when the incident occurred and which judge has room in his/her schedule. As we mentioned above, San Jose judges sentence all convicted defendants in DUI cases to a drug and alcohol education program. California DUI School programs can be as short as a few weeks and as long as three years-which one you're ordered to complete depends on your DUI history and BAC level.
