What are level 2 drug felony penalties in Colorado?

Under Colorado law, there are two sentencing ranges for drug felonies: "presumptive" and "aggravated." Presumptive is the typical, default sentence. However, the judge may decide to order a harsher sentence if there are "aggravating factors," such as if the defendant was:

  • on parole,
  • on probation or bond for another felony,
  • in confinement for a felony,
  • an escapee from confinement for a felony

Presumptive level 2 drug felony penalties

  • 4 to 8 years imprisonment, and/or
  • $3,000 to $750,000 in fines

There is also a mandatory parole period of 2 years.

Aggravated level 2 drug felony penalties

  • 8 to 16 years imprisonment, and/or
  • $3,000 to $750,000 in fines

There is also a mandatory parole period of 2 years.

Other level 2 drug felony facts in Colorado

People charged with drug felonies in Colorado have the right to a trial by jury of twelve jurors. (If the court approves it, the defendant can instead choose to have a bench trial or a tinier jury of six to eleven people.) It may be possible to get the charge sealed from the defendant's criminal record, depending on the charge and how the case turned out.
