What are drug petty offenses in Colorado?

Offenses relating to marijuana and marijuana concentrate.

  1. Any person who possesses not more than two ounces of marijuana commits a drug petty offense.
  2. Any person who openly and publicly displays, consumes, or uses two ounces or less of marijuana commits a drug petty offense.
  3. Any person who transfers or dispenses two ounces or less of marijuana for no consideration commits a drug petty offense.

Authorized possession of controlled substances. Any person who possesses a prescribed controlled substances in a container other than that in which it was dispensed and who is unable to show legal ownership commits a drug petty offense.

Possession of drug paraphernalia. Any person who possesses drug paraphernalia and who knows or reasonably should know that the paraphernalia could be used under circumstances in violation of the laws of this state commits a drug petty offense.

What are drug petty offense penalties in Colorado?

The maximum penalty for drug petty offenses is $100 in fines. The court may also order 24 hours of community service for a person who openly and publicly displays, consumes, or uses two ounces or less of marijuana.
